These Terms and Conditions ("Terms") govern your access to and use of the website at servetrain.co and all related services, products, and training courses provided by Servetrain LLC ("ServeTrain," "we," "us," or "our"). By accessing our website, creating an account, or enrolling in any course, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

1. Acceptance of Terms

By registering for an account, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. Your continued use of the website constitutes ongoing acceptance. We may also ask you to explicitly confirm your acceptance during registration or enrollment.

These Terms may be supplemented by additional agreements related to specific products, services, or corporate accounts. If any provision of an additional agreement conflicts with these Terms, the additional agreement will control for that specific matter.

2. Eligibility

Our training courses and certification services are intended for individuals who are of legal working age in the alcohol service industry in their respective state. By enrolling in a course, you confirm that you meet the minimum age requirements set by your state for employment in alcohol service and that all information you provide during registration is accurate and complete.

3. Account Registration and Security

To access our training courses, you must create an account and provide accurate, current information during registration. This may include your full name, email address, date of birth, and state-issued Server ID number (where required by your state's alcohol control agency).

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately if you become aware of unauthorized access to your account

You may not share your account credentials with any other person or allow another individual to complete coursework under your account. Each student must maintain their own individual account. After account termination, you may not register a new account without our written permission.

4. Course Enrollment and Access

Individual Enrollment

When you purchase a course, you receive access to the training content for a period specified at the time of enrollment. Course access is granted to the individual whose information is entered during registration. Access is non-transferable.

Corporate and Group Enrollment

Employers and managers may purchase course access for multiple employees through our corporate enrollment system. Coupon codes issued for group enrollment are valid for the number of seats purchased and may not be resold, redistributed outside the purchasing organization, or used for purposes other than employee training.

Course Completion Requirements

State regulations require students to complete a minimum number of training hours before certification. Each lesson includes a time requirement to ensure adequate engagement with the material. You will not be able to advance to the next lesson until the required time has been met. Passing the final examination with a minimum score of 80% is required to receive your completion certificate.

5. Certification and Certificates

Upon successful completion of the course and final examination, ServeTrain will issue a completion certificate in PDF format bearing your name and the date of certification. This certificate confirms that you have completed ServeTrain's approved training program.

Your ServeTrain completion certificate is valid for the period specified by your state's regulations (typically 2 to 3 years from the date of issue). It is your responsibility to track your certification expiration date and complete renewal training before it expires.

The ServeTrain completion certificate is not the same as state certification. In states that require a separate state-administered exam (such as California), you must independently register for, take, and pass that exam within the timeframe specified by your state's alcohol control agency. ServeTrain is not responsible for your performance on any state-administered examination.

6. Payment Terms

  • All course fees are due at the time of enrollment and are processed through our secure online payment system
  • We accept major credit cards (Visa, MasterCard) and debit cards bearing a Visa or MasterCard logo. Prepaid credit cards are also accepted
  • We do not accept cash, personal checks, or wire transfers for individual course purchases
  • All prices are listed in U.S. dollars
  • Corporate accounts and group purchases may have separate payment arrangements as agreed in writing

7. Refund Policy

Refund eligibility depends on the extent to which you have accessed the course content:

  • Before starting the course: If you have not accessed any course content, you may request a full refund within 7 days of purchase
  • After starting the course: Once you have accessed course content (opened any lesson or quiz), refunds are not available. Because the training is delivered digitally and progress begins immediately upon access, we cannot reverse the delivery of the service
  • Corporate/group purchases: Unused coupon codes may be eligible for refund or credit. Contact our sales team for corporate refund requests

To request a refund, contact us at info@servetrain.com or call (888) 679-5740. Approved refunds will be processed to the original payment method within 10 business days.

8. Intellectual Property

All content on the ServeTrain website and within our training courses, including text, video, audio, graphics, logos, software, and the overall design and layout, is the property of Servetrain LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, distribute, or publicly display any content from our website or courses
  • Record, download, or capture video or audio from our training modules
  • Reverse engineer, decompile, or attempt to extract source code from our platform
  • Use our trademarks, logos, or brand elements without prior written permission
  • Create derivative works based on our content
  • Sell, resell, license, or commercially exploit any content from our platform

Limited, non-commercial use of our content for personal study purposes during your active enrollment is permitted.

9. Acceptable Use

When using our website and services, you agree not to:

  • Provide false or misleading information during registration or enrollment
  • Allow another person to complete coursework or examinations on your behalf
  • Attempt to manipulate, bypass, or circumvent course time requirements or examination scoring
  • Use automated tools, scripts, or bots to interact with our website or training platform
  • Upload, transmit, or distribute malicious software or code
  • Collect or harvest personal information of other users
  • Interfere with the performance, availability, or accessibility of our website
  • Use our services for any purpose that is unlawful or prohibited by these Terms

Violation of these acceptable use provisions may result in immediate termination of your account without refund.

10. Manager Accounts and Violation Tracking

Manager accounts provide access to additional features including employee training status tracking, compliance reporting, and the violation tracking database. By applying for a manager account, you agree to the following:

  • You will provide a valid liquor license number during registration, which ServeTrain will verify before granting access (typically within 24 hours)
  • You will use the violation tracking database and employee records solely for legitimate employment screening and compliance purposes
  • You will not share manager-level access credentials with unauthorized individuals
  • You are responsible for ensuring that your use of employee data complies with all applicable employment and privacy laws

If your manager account application is declined, any payment will be refunded in full.

11. Electronic Communications

By creating an account or contacting us through our website, you consent to receive electronic communications from us, including enrollment confirmations, course completion notifications, certification expiration reminders, and service-related announcements. You agree that these electronic communications satisfy any legal requirement that such communications be in writing.

We will not send unsolicited marketing emails. Service-related communications are a necessary part of delivering our training and cannot be opted out of while your account is active.

12. Third-Party Websites and Services

Our website may contain links to third-party websites, including state regulatory portals (such as the California ABC RBS Portal), payment processors, and social media platforms. These third-party sites operate under their own terms and conditions. We do not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party website.

Your interactions with third-party services, including state-administered certification exams, are governed by the terms and policies of those third parties.

13. Disclaimer of Warranties

Our website and all content, courses, and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • Our website or services will be uninterrupted, timely, secure, or error-free
  • The results obtained from using our training courses will meet your specific expectations or guarantee passage of any state-administered examination
  • Any errors or defects in our website or course content will be corrected

Nothing on this website constitutes legal, financial, or professional advice. If you require advice regarding alcohol service regulations, licensing, or liability, consult an appropriate professional.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Servetrain LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to your use of our website or services, regardless of the theory of liability.

Our total cumulative liability for all claims arising from or related to these Terms or your use of our services shall not exceed the amount you paid to ServeTrain for the specific course or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Servetrain LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of our website or services, or your violation of any law or the rights of any third party.

16. Termination

We may suspend or terminate your access to our website and services at any time, with or without cause, and with or without notice, if we reasonably believe that you have violated these Terms. Upon termination, your right to access course content ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue to apply.

You may request account deletion by contacting us. Account deletion does not entitle you to a refund for completed or in-progress courses.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

18. Idea Submissions

Do not submit any ideas, inventions, works of authorship, or other information that you consider your own intellectual property unless we have first signed a written agreement regarding intellectual property or a non-disclosure agreement. If you submit such materials without a written agreement, you grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate, and distribute your submission in any existing or future media.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any additional agreements entered into in connection with specific services, constitute the entire agreement between you and Servetrain LLC regarding the use of our website and services, and supersede all prior agreements, understandings, and communications.

For material changes, we may provide additional notice through our website or by email. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
